These terms govern your use of zilbert.com and the services offered on it. By using the site you accept them; by creating an account you accept them again and we record the version you accepted. If you do not agree, do not use the site.
Who we are
The site is operated by Mark Zilbert, a Florida licensed Broker-Associate of ONE Sotheby's International Realty, and by Zilbert Realty Group, Inc., doing business as Zilbert, a North Carolina real estate brokerage. Real estate services in Florida are provided through ONE Sotheby's International Realty; in North Carolina through Zilbert Realty Group, Inc.
Listing information
Listing information on this site comes from the Internet Data Exchange programs of the Miami Association of Realtors and Canopy MLS, and from other sources we believe reliable. Each MLS's required notices, disclaimers and terms for the display and use of its data, as published by that MLS and revised by it from time to time, are incorporated into these terms by reference and appear beside the listings they govern. It is provided for your personal, non-commercial use to identify properties you may be interested in buying or renting, and for no other purpose. It is deemed reliable but is not guaranteed; measurements, taxes, fees and availability should be verified independently. Listings held by brokerages other than ours are identified with the listing brokerage's name. The information is updated regularly and may be out of date at any moment; a property shown may have sold, been withdrawn or changed price.
What you may not do
You may not copy, scrape, harvest, republish, frame or redistribute listing information or any other content on the site; use automated means to access it except as search engines ordinarily do; use it to build a competing product or a mailing list; misrepresent who you are; interfere with the site's operation; or use the site in violation of any law, including fair housing laws.
Your account
You are responsible for keeping your password confidential and for what happens under your account. Tell us at once if you believe it has been compromised. We may suspend or close an account that violates these terms.
Communications
By giving us your email address you agree that we may email you about your account, your saved searches and alerts, and the site. You can unsubscribe from marketing email at any time. Text messages and calls are made only with your prior express consent, given when you turn on text messages in your profile or reply to a message from us; every message identifies Zilbert and gives you a way to reach us; you can withdraw consent at any time by replying STOP to any message, by turning the switch off in your profile or by writing to us, and we honor the National Do Not Call Registry and our own do-not-contact list; message and data rates may apply. Ask Mark is a way to write to us and is not a substitute for advice from your own attorney, lender, inspector or tax adviser.
Estimates and tools
Prices, "what your home is worth" figures, monthly cost estimates, property tax estimates and similar tools are estimates produced from public data and MLS data. They are not appraisals, offers, or guarantees, and they should not be relied on for any decision without independent verification.
No agency by browsing
Using this site does not make Zilbert or Mark Zilbert your agent. An agency relationship is created only by a written agreement, and the brokerage relationship disclosures required by Florida and North Carolina law will be provided to you before that point.
Housing laws
Neither this website nor Zilbert, Mark Zilbert or their affiliates sells or rents housing. The responsibility for compliance with federal, state and local fair housing laws rests with the actual seller or landlord. By using this website you agree not to look to Zilbert for compliance with such laws and agree to indemnify, defend and hold Zilbert harmless from any such claims. Zilbert supports the Fair Housing Act and does not tolerate discrimination; see our Fair Housing page.
Florida
Real estate services for Florida property are provided by Mark Zilbert as a Broker-Associate of ONE Sotheby's International Realty, licensed by the Florida Department of Business and Professional Regulation. Florida's brokerage relationship disclosures (Florida Statutes section 475.278) are provided before any agency relationship is formed. Florida law governs these terms as set out below.
North Carolina
Real estate services for North Carolina property are provided by Zilbert Realty Group, Inc., doing business as Zilbert, a brokerage licensed by the North Carolina Real Estate Commission. The Commission's "Working With Real Estate Agents" disclosure is provided at first substantial contact. North Carolina property does not appear on this site until version 1.1; this paragraph applies from the day it does.
Intellectual property
The site's design, text, photographs we own, logos and software are ours or licensed to us. Listing photographs belong to the listing brokerages and photographers and are shown under the MLS rules. Building and developer names and logos belong to their owners and are used to identify the buildings.
Copyright complaints

Disclaimers and limitation of liability
The site is provided as is. To the fullest extent the law allows, we disclaim warranties of every kind and we are not liable for indirect, incidental or consequential damages, or for any loss arising from your reliance on information on the site. Nothing here limits liability that cannot be limited by law, including our duties to you as a licensed broker once an agency relationship exists.
Governing law and disputes
These terms are governed by the laws of the State of Florida without regard to its conflict-of-laws rules. Before filing any claim, you and Zilbert agree to try in good faith to resolve any dispute arising from these terms or from your use of the site by written notice to the other, and if it is not resolved within 30 days, by non-binding mediation in Miami-Dade County, Florida, with the cost of the mediator shared equally. Any dispute not resolved by mediation shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in Miami-Dade County, Florida; judgment on the award may be entered in any court with jurisdiction. Either party may instead bring a claim within the jurisdiction of a small claims court. Claims may be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. To the extent a matter proceeds in court, it shall be brought exclusively in the state or federal courts sitting in Miami-Dade County, Florida, and you consent to their jurisdiction and venue. Changes
We may change these terms. When we do, the new version is posted here with its effective date, and account holders will be asked to accept the new version on their next visit if the change is material.
