Privacy Policy

This policy explains what Zilbert collects when you use zilbert.com and the sites and messages that carry the Zilbert name, why we collect it, who else touches it, and the choices you have. "Zilbert", "we" and "us" mean Mark Zilbert, a licensed real estate broker in Florida and North Carolina, and Zilbert Realty Group, Inc., doing business as Zilbert. In Florida, Mark Zilbert is a Broker-Associate of ONE Sotheby's International Realty; in North Carolina, Zilbert Realty Group, Inc. is the brokerage. The contact details are at the end.

What we collect and why

When you visit without an account. We set one small first-party cookie on your device that holds a random identifier and nothing personal. With it we record which pages you view, the page you came from, your browser type and the country you appear to be in, so that we can see which parts of the site are used and keep the site working. We also remember the city you look at, so the site opens there next time. We run Google Analytics with your IP address anonymized, with Google's advertising features turned off and with no cross-site signals. If you search for something the site cannot find, we keep the words you typed, without any identifier, so the search learns. When a promoted development is shown or clicked, we count it; the developer sees a count, never a person.

When you create an account. We ask for your name and email address, and optionally your phone number, and we record the version of the Terms of Use you accepted. From then on, the pages you view are part of your record with us, including the pages you viewed on the same device before you signed up. Saved searches, hearts, alert settings and the digests we send you are kept so we can provide them.

When you write to us. Ask Mark on the site, email, and text messages are kept as a record of the conversation so we can respond and follow up. Real estate conversations are kept for as long as licensing rules require us to keep transaction records.

What we never collect. We do not collect precise location. We do not use facial recognition or fingerprinting. The site is not directed at children under 18 and we do not knowingly collect information from them.

Who else touches your information

We use service providers to run the site and they process information only for us: Render (application hosting), Neon (database), Cloudflare (network, security and image delivery), Google (analytics, as described above), Resend (transactional and alert email), Mailchimp (newsletters and list email), Twilio (text messages) and accessiBe (the accessibility widget). Listing data on the site comes from the Miami Association of Realtors and Canopy MLS under their rules; when you inquire about a listing we may share your inquiry with the listing brokerage as those rules provide.

We do not sell personal information. We do not share it for cross-context behavioral advertising. We do not give it to other brokerages or agents unless you ask us to introduce you.

We disclose information when the law requires it, to protect our rights or the safety of others, or as part of a sale or reorganization of the business, in which case this policy continues to apply.

How long we keep it

A visitor record that never leads to an account or a message is deleted after thirteen months. An account and its records are kept while the account exists and for the period licensing and tax rules require afterward. You can ask us to delete your account at any time; records we are required to keep are retained only for that purpose.

Your choices

You can browse without an account. You can clear or block cookies in your browser; the site will forget your city and count you as a new visitor. You can unsubscribe from any email using the link in it, and from all email using the link at the bottom of every digest. You can stop text messages by replying STOP or by turning the switch off in your profile. You can view, correct or delete your account information from your profile, or by writing to us.

Florida

Zilbert follows the Florida Digital Bill of Rights as if it applied to us, whether or not we meet its thresholds. If you are a Florida resident you may confirm whether we process your personal data and access it; correct inaccuracies; delete personal data you provided or we obtained about you; obtain a copy of your personal data in a portable form; and opt out of the sale of personal data, of targeted advertising and of profiling in furtherance of decisions that produce legal or similarly significant effects. We do not sell personal data, we do not run targeted advertising and we do not profile you in that sense. We do not collect sensitive data, and we do not collect voice or facial recognition data. To exercise a right, write to the Florida address below; we will respond within 45 days, and if we decline a request we will tell you why and how to appeal to us. You may also contact the Florida Department of Legal Affairs.

North Carolina

When you use the site for North Carolina property, Zilbert Realty Group, Inc. is the brokerage and this policy applies to it in the same way. North Carolina has no comprehensive consumer privacy statute at the date of this policy; we honor the requests described in this policy from North Carolina residents on the same terms as from everyone else. Real estate records for North Carolina transactions are kept for the period the North Carolina Real Estate Commission requires.

Other states

If you are a resident of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon or another state with a consumer privacy law, you may have rights to know, access, correct, delete and port your personal information and to opt out of its sale or sharing. We do not sell or share personal information within the meaning of those laws, and we honor requests to know, access, correct and delete from anyone, wherever they live. Write to the address below; we will verify the request and respond within the time the law provides. We will not treat you differently for exercising these rights.

If you are in the European Economic Area, the United Kingdom or Switzerland, we ask for your consent before setting any cookie or running analytics, and you can withdraw it from this page. Our legal bases are consent for cookies and analytics, contract for your account and the services you ask for, and legitimate interest for keeping the site secure and for answering you when you write. You may lodge a complaint with your supervisory authority.

Security

Information is transmitted over encrypted connections and stored with providers that maintain industry-standard security. Passwords are stored as one-way hashes. No system is perfectly secure; if a breach affects your information we will notify you as the law requires.

Changes

When this policy changes we will post the new version here with its effective date. If the change affects how we use information you have already given us, we will tell account holders by email before it takes effect.
